• Who Is Responsible For Legal Costs When Selling A Share Of Freehold Flat?

    We own a share of freehold flat in a two flat building and the other owner now wants to sell his share of freehold flat. We have appointed a solicitor to represent us and informed the solicitor that the seller must pay for all our legal, and associated, costs in advance. However, our solicitor has requested that we pay them a fee up-front and appear unwilling to confirm that any additional costs we may incur (such as from certifying identity documents etc) will be met by the seller in advance.

    We are happy for the sale to proceed, but could you please confirm whether we are within our rights to ask for prior payment from the seller, either via both solicitors or directly from the seller, for any work that may be required at any stage of the sale.

    On different note, should we also be seeking to change our solicitor as it feels that they are not working in our best interest.
