• Trustees And Proprietor

    we want to purchase a property which was put in trust as there are 6 beneficiaries, there is also a proprietor on the land registry.The trust company are insisting they have authority to sell in there name only,wihout the proprietor named on the the sale form but the said proprietor is signing the sale agreement. is this legal.

    Your conveyancer will advise you. Generally the persons who must be party to the deed are the persons named on the title register for the property, which could be the trust company but look at entry B1 of the register.

    There are rare exceptions to this such as sales by mortgagees in possession.
