• Purchased A Property But Later Found Not All The Land Came With It (conveyance And Land Registry)

    My parents bought a bungalow by the sea, very happy and one day whilst doing "their" garden the neighbour two doors up who owns the shared drive way that everyone has access over that it's his land not theirs. Since looking into it, it's not my parents land but it's not the neighbours either. It actually belongs to a dead man. The previous owners maintained this land for 20 years. My parents contacted the solicitor who confirmed it wasn't theirs. My parents applied for the land but it was declined and advised they could reapply in 12 months. In the meantime my parents have been subjected to harrassment and the police have said to the neighbour he is to stay away from my parents and their property. Now somehow the neighbour has had the lan transferred into his name and also managed to have the covenants changed that my parents once had access over the land to no access at all and he has rights to put a fence up too. How could he of had this land transferred when land registry were aware of the dispute and that my parents had applied and since followed up and aquifer about the land? How could he have the covenant changed? If he puts a fence up it will make it very difficult for my parents to access their drive and their not going to want a fence slap bang in front of their conservatory. What's annoyed me most is the estate agents did not mention this and neither did the solicitor. When we contacted the solicitor all she said after confirming it wasn't my parents was that it would need to go through her litigation team but wasn't sure on the cost and my parents weren't sure they could afford it. I would just like to know how did this happen and now that it has what can my parents do about it? Many thanks in advance for your help.
