• No Consent From Freeholder

    Buying a house , conversion done more than 8 yrs ago , council permission was obtained but no consent from freeholder was obtained !!!! Do I need indemnity insurance to cover this ??

    You usually have 3 options: (1) Ignore the breach (at your own risk - not available if you are using a mortgage), (2) Obtain retrospective consent from freeholder (usually most cautious option if you are the Buyer - be aware of risk of freeholder refusing consent or charging a premium for it), (3) Obtain an indemnity policy (best option for the Seller, and the quickest). Note that (2) and (3) are mutually exclusive - you cannot ask for consent then obtain an indemnity.

    Thank you v much .
    I think indemnity insurance is the best option here as you suggested . Would it cover any costs in future claimed by freeholder ? Would indemnity insurance help not to affect me if want to sell in future ?
