• New Build Shared Ownership, Solicitor Won’t Exchange Contracts Until Proof Of Ownership By Association Is Shown

    Our solicitor won’t exchange contracts with our housing association until she sees proof that they are legally bound to buy the property from the developer.
    We can’t wait until ownership has passed to them because the property will be re marketed by then.
    She just needs to see the contract between the developer and the association saying that they will own the property, therefore giving them the legal right to sell to us. The sales rep of the association called us, putting the fear of god into us, saying he’s never known this before, he doubts the contract between the association and developer will be shared as it’s confidential, and they will have to re market if this doesn’t get sorted.
    We’ve used a family member who is a property solicitor, whereas people usually use the recommended solicitors, who I’m presuming don’t go through this issue for whatever reason.
    What are our options in this case? We just want to exchange contracts.
