• Lease And Freehold On Same Property

    I am interested in a property which has been divided into 2 parts. Upstairs is freehold and downstairs is leasehold. Both parts are being sold, but I wondered who would own the lease and also, when buying the property would the leaseholder need to be notified?

    All properties have a freehold title and some have leases granted out of the freehold. So from what you say I suspect that there is a building containing two flats and in respect of the lower flat, a long lease has been granted. If you are buying both flats then you will acquire the freehold and leasehold titles, so that you will be both the landlord and the tenant.
