A new house built circa 2006 had 'full plans building control approval' and the local authority building control department carried out most of the site inspections including foundations, drainage, damp courses etc. but were never called back to carryout the final inspection. The building control department have recently been asked to carryout the final inspection but have refused as they say too long a period of time has passed since their last inspection in 2006. The house has been occupied for 14 years but I am sure the lack of a building control final certificate will be raised during any future sale. Your advice on how best to proceed to mitigate any delays when the property is put up for sale would be appreciated? My local building control department seem unwilling to help or provide any alternative options. Is it best to continue to push the council to provide a resolution? or take some alternative course of action?
Normally you could just take out an indemnity policy but as you have approached the local authority it will probably not be valid. Ideally you could ask for a "Regularisation Certificate" (retrospective approval) from the building control department.
I guess another option you could purchase the Lack of Building Regulations indemnity and although it would not be valid (so would not protect you) in 99% of cases I've never had a buyer's lawyer ask me about the validity of an existing indemnity policy so I suspect they would tick the box for building regulations on sight of it without asking further!
