• Defect In Title

    Hi, we put our property up for sale, a prospective buyers solicitor has raised concerns regarding a close/pend in common ownership. the issue is the fact that a small section of our living room sits over the close/pend, because the title for several properties does not mention this the titles we have been informed are defective. I have been advised that defects dates back to when the property was conveyed in 1937. the defect has not been picked up in previous sales. We now seem to be facing potential cost for corrective conveyancing for all the properties with a right in common to the close. This is not something I think should be my sole responsibility. any advice would be greatly appreciated. the property is situated in Scotland
