• Contract Exchange - Size And Specifications

    Hello,
    I am buying a New Built Flat and the seller's solicitor refuses to include in the sale contract and lease agreement any mention to size, specifications and furniture of the flat, which were presented to us in the marketing brochure (itself not mentioned in the contract nor lease). My conveyancer says that it is standard for new built but does not provide any specific reason/regulation. I am afraid of the risk that after exchanging contract, the flat may be delivered on completion with smaller size and worse specs & furniture. Can you please advise if there are any standards or regulations that I can oppose to the solicitors to force them including a wording about size, furniture and specs?

    Your solicitor is correct and it is very unlikely that the seller's solicitor will agree to alter the contract. It is not normal to include size specifications in the contract. The finished property must not however differ substantially from what was originally offered.

    Thanks for your reply. If the size is not specified in the contract and the marketing brochure is also not referenced in the contract, then, if the property is smaller than planned on what grounds can I prove that it "differ substantially from what was originally offered"? Because the last three paragraphs of the contract explicitly state that any information not referenced or written in the contract has no value.
