• Buying Leasehold Flat (new Build) On Unregistered Land

    Good Day,
    We are in the process of buying a new build flat in London (help to buy scheme). We have not exchanged yet. Our conveyancer has raised the issue of part of the plot being on unregistered land (it's around 1m). Three flats are built above this unregistered land.
    We are unsure of the ramifications as to when we go to register our purchase with the land registry, please can you advise?

    Your conveyancer will need to examine the epitome of title to ensure the seller has legal title to the land.

    Following completion the new leasehold title will be registered in your name. Registration of unregistered land can take around 12 months. The landlord's freehold will likely remain unregistered.

    Thanks so much for your response Notary Express.

    Judging by the go-between with the seller's solicitor and our conveyancer, they aren't providing any title information for the unregistered land - just an indemnity policy to cover adverse possession, up to $1.7m.

    Is it possible to register the leasehold even on this basis? Our current conveyancer has little to no knowledge on this issue.
