• Agents Commission

    Hi, I cancelled my offer to purchase because I found defects on the property (cracked walls, broken walls, mildew and water damage inside the cupboards) that I was not made aware of by the agent. Am I still liable for the agent's commission, as they did not disclose the defects? I signed the transfer document but stopped the transfer process thereafter. Regards

    The agents do not have a duty to disclose defects. The legal maxim "caveat emptor" or "buyer beware" applies and as the purchaser you must carry out your own surveys and inspections. I'm not sure why you would be liable for the agents' fees in any event though because:

    1) The agents' fees are paid by the seller and
    2) They are only payable on completion of a sale

    I am assuming that the property in question is in England or Wales
