• Freehold On Title Deed

    Could it be shared Freehold or would this be detailed on the deed? A surveyor has visited the property and suggested that it is a leasehold tenure or shared Freehold, however the deeds do not state this. It states it is Freehold

    If the deeds state freehold, it is freehold. If the deeds state leasehold, it is leasehold.

    A share of freehold is basically a leasehold property but with the tenants collectively owning the freehold (either as joint freeholders or through a freehold management company).

    Thanks for your answer to this. The property was advertised as a one bedroom house when we purchased it but it doesn’t state that on the deeds. The surveyor is saying it’s a freehold flat or maisonette and that lenders will not lend on Freehold flats. The title plan shows a land boundary and highlights the ground and upper floor to be ours. Does that support our case of it being a one bedroom house? The epc rating states it as being an end of terrace house...confused???

    Can you describe the layout of the building? I.e. as far as you are concerned are you buying the whole of the building or only part of it and if only part of it, which part?
