• Vacant Land Possession

By Guest on 01st May 2019

The parcel of land next door to our house would appear to be without ownership. Having asked the previous owner of our property who had lived in the house for 60 years, it’s always been empty. Apparently an old lady who lived in the ruin at the center of the Overgrown land, died approx 100 years ago and had no next of kin. From this point on it became a ruin and no one has lived there since. We didn’t even know there was a ruin in it until we explored further. How do I find out if it is without ownership and buy or claim it myself.

    1) Check HM Land Registry to see if registered
    2) If not registered make discreet enquiries with neighbours to see if anyone knows who owns it
    3) If you have been using the land for over 12 years and believe it to be yours (which does not sound like the case) then you could apply for registration by adverse possession with HM Land Registry
    4) Otherwise contact the Crown Bona Vacantia department as the land may have lapsed unclaimed to the Crown.
