    Hi can anyone help
    Parents left house to myself and sibling Brought brother out so property is in my name only eg I own it
    Now in middle of Selling house & just found out that my old solicitor never took his name off as a trustee on deeds-land registery
    My new solicitor has sent a letter for him to sign so i can go ahead with selling my house.
    Is it normal for my solicitor to tell him to get legal advice before signing aid form as he asked for me to pay for him to see a solicitor ( which I've agreed to) before he signs as my solicitor told him to do so
    Asked first solicitor for a refund for their mistake but so far hasn't answered where do I stand

    Hi,

    Your lawyer is obliged to recommend that your brother sees legal advice. If your brother chooses to do so, that's his right and I do understand why he wants you to pay for it. If you instructed a previous lawyer to deal with the transfer ownership into your sole name and if he failed to do so, you should pursue this and he should be compensating you for fees you have to pay now. Obviously without sight of your instructions to the lawyer and any correspondence I couldn't comment as to whether he was actually negligent.
