• Tree/Shrubs Planting In A Front Garden

    My neighbours' house in Glasgow is on a dangerous road junction and has restricting tree planting height of 1 Metre. The neighbour has planted two high growing conifers (4 Metres in height) which has introduced a significant blind spot when approaching and leaving the junction. Several near misses have occurred including a pedestrian. The house owners are in their 80's and spend much of the year in Spain. I have spoken to them about the problem the trees are causing but they refuse to reduce the height. Please can you advise the process involved to enforce compliance with the tree height stipulation stated in the title deeds?

    We advise you instruct a litigation firm or dispute resolution solicitor who will advise you on the options available to you, which could range from reporting the matter to the highways authority to court action to enforce the restrictive covenant.
