• Transfer Of House Ownership

    My mother and stepfathers home is in joint ownership. My stepfather is now living in a care home with Dementia. We have an enduring power of attorney which has been approved legally and the attorneys are my mum, myself and brother. (stepsons). My mum wants to leave the family home to a
    more suitable property for her needs.
    If the property is transferred from my stepfather to my mum only would we still be liable to split the equity to fund my stepfathers care fully? At present he part funds from pensions etc. This would allow my mum to fund ownership of a property rather than the equity being used to fund care for then both. Hopefully I have explained things clearly. Basically we are trying to avoid their equity being used to fund the care for them both.
