• TP1 Incorrect

By Guest on 09th Oct 2023

It has come to light that the TP1 for my property was completed incorrectly. The schedule referring to the maintenance expenses states "the transferees proportion shall be 1/74" but the estate comprises of 64 chargeable properties. I am now in dispute with the Management Company as I feel I should only be paying what is stated in the TP1. The property was purchased 9 years ago. Does this need rectifying and how? Will there be a cost involved? I feel that if there is then the management company should be paying. Thank you

I suggest you refer back to the conveyancer who acted for you at the time. Does the management company perform a useful function? It's worth bearing in mind that if it cannot collect enough contributions then it will no longer be able to perform that function

Thankyou for your reply. The conveyancer I used have said that it is outside of their remit to advise on this and that I need a Civil Solicitor. The only thing that the Management Company maintain is an underground SUDS holding tank that has no access and seems maintenance free anyway.
