• Tenants In Common - Substitute Dec'd Owner With Beneficiaries

    Hello
    My late father owned his home outright as tenants in common with my stepmother. In his will he has left his half to his 3 children. My stepmother's brother and I are executors in my father's will. Without obtaining probate on his estate, is it possible for my stepmother to update the title so that she and his 3 children become tenants in common but with unequal shares, ie 1/2 for her and 1/6 for each child?

    If so, would your Transfer of Equity Kit be appropriate?

    No - you will need a grant of probate to transfer property in England & Wales.
