• Solicitor Unable To Trace Final Copy Of DoT

    Over 10 years ago I took out a mortgage against my parents property (with my then partner) to release equity for them as they were considering using an equity release company. As part of the arrangement the solicitor we used at the time registered all four of us as Tenants in Common and drew up a DoT based on the following percentages: 1% Mum, 1% Dad, 24% My Partner and 74% me. I have recently been asked to provide a copy of the DoT however I have since learned from speaking to the Solicitors that they can't locate a final copy of the DoT either electronically or paper. All they hold is a draft. This is now hugely stressing me out as for over the last 10 years I always thought the percentages were legally recorded somewhere? Am I right to assume that without a final copy of the DoT all four of us own equal amounts of the property?
