• Restriction On My Title Deeds?

    My ex partner was made bankrupt. He had no money in my house but was on the title deeds and so i brought his beneficial interest for £1 from the official reciever. I appointed a solicitor and have a deed of assignment but my title deeds still show the following restriction. "No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court." I have now removed my ex partner from my title deeds and the mortgage is paid off. I am unsure what this restriction means? I am hoping to get another mortgage on my property so i can do some home improvements. Would this prevent that? Is there anyway to remove the restriction? Thanks for any help.

    Hi,

    This is commonly referred to as a "Form A restriction" or "sole proprietorship restriction". Yes it would need t be removed before (or at the same time as) you remortgaged but don't worry, you can submit an application to the Land Registry under form RX3 with a Statement of Truth explaining that you are solely legally and beneficially entitled to the property and that will be enough to remove it. Ask your solicitor when you come to remortgage
