• Release Of Land And Creating New Title Deed

    I have extended a property with planning permission for an extension and now wish to separate the title on the land to create two separate titles. The property has a mortgage of 150,000 and is valued at 500,000. Is this possible ?

    You can ask HM Land Registry (HMLR) to do so with a discretionary application - they will refuse.

    You can force the split by transferring part of the land to someone else, either on a sale or by transferring it to a friend/family member/company (bear in mind you will lose control of the land to that third party) which will need lender consent - unless it's a sale in which case you'd need to pay off the mortgage (or a discharge of part with lender consent) to complete it.
