• Problem With Criss Cross Lease Freehold Title

    My husband owns the leasehold title of a flat in London. His title was supposed to go hand in hand with the freehold title of the flat above it, however we have discovered that the freehold still belongs to the previous owner. It was a repossession, and the previous owner can now not be traced. If we could trace him, we could ask him to sign the TR1 form because the freehold title is worth nothing to him, in fact it could be a liability because legally at the moment, he could be asked to pay for communal repair charges( if he could be traced). This is known as a criss cross lease, and the leasehold owner of the flat above also holds the freehold title of my husbands flat. We spent 6 months trying unsuccessfully to trace the previous owner, and our lawyer has since then spent 6 months trying to get the land registry and/or the tribunal to correct the entry. This has been totally unsuccessful, can you give us some guidance or how to get the entry corrected please
