• Overriding Interest

    Should an overriding interest created in 2002 have been noted on the first registration title in 2004 or even subsequently on a new owner transfer in 2011
    if not is the agreement Binding?

    Without being aware of the specific circumstances and what the interest is, this is hard to answer, but from a very general perspective yes the overriding interest should be added when the property was registered if the person registering the property was aware of the interest. If it was not registered the interest will subsist as overriding by its nature.
