• Old TR1 Restriction Valid

    Hi , we bought a freehold house in 2010 and completed a TR1 form to document our relative share in the house ( deed of covenant 85/15). I now wish to buy my partner out and the solicitors have said there is a restriction on a TP1 form dating back to 2006 that requires a housing authority signature before the sale goes ahead . Is this correct ? The TP1 form was signed by previous owners that presumably bought from the housing authority. My partner and I have full title per the TR1 form . Does this not supercede that TP1 document ? Thanks in advance Debbie

    Restrictions last in perpetuity (forever) with a few exceptions (e.g. extinguishment when both the benefited and burdened land are held by same person). It is most likely it remains valid.
