• New Build TP1 Restrictive Covenant

    Restrictive covenant on a new build house we are buying states, we are "Not permitted to hard landscape any areas of the garden which are soft landscaped". The developer only provides two block paving slabs in the rear garden. So this would prevent us from having a small patio, or even a small path in the garden. Can this ridiculous covenant be easily removed from the TP1 before we exchange contracts?

    Assuming the seller is the developer and this is a new TP1 not a historic title document, then you should liaise with the developer to request they remove it. They might refuse citing it's their standard template for the estate, but no harm in asking.
