• Name Not Put On Deeds

    Hello I bought a freehold house with my brother and when we tried to claim the extra stamp duty back because we sold a property we inherited from our brother. When we filled a form in online to the tax department they said my name wasn’t on the deeds. Is it the responsibility of the solicitor who did the conveyancing to rectify this mistake? They seem to be avoiding our emails.

    There are 3 possibilities I can think of: 1. When you initially instructed the lawyers you told them to put both of you on the deeds and they failed to do so - likely the lawyer is at fault in this scenario; 2. The above plus the lawyer filed it correctly and HM Land Registry (HMLR) made an error - in this case HMLR would be responsible and would likely rectify it if you contact them. Check who was down as Transferee on the transfer deed as that will answer this one for you; or 3. Perhaps you only instructed the lawyers to put one of you on the deeds but have forgotten as it was some time ago. In this case it is likely you would be responsible. You may wish to consult a professional property litigation solicitor for further assistance.
