    My wife and I are separated and divorce proceedings are due to commence shortly. Despite being joint proprietors of the marital home, I have just discovered that my wife has put our home up for rent without my knowledge. What are my rights

    If you are joint owners then usually you will be joint "trustees" and joint beneficiaries. This usually happens automatically, you don't need to enter into a formal trust deed. What these means is that you each need to act in each other's best interests and according to each other's wishes. So in renting out the the property without your consent your wife is on the face of it committing a breach of trust, which is actionable
