• Local Builders Access To Put Facilities Through My Property

By Guest on 18th Nov 2023

A local building company that have plans for new local housing build have to put the main waste drain through my back garden under my drive and into the street at the front of my house. What rights do i have to contest this and what is reasonable for them to provide. Would this also then prevent me form build out my own property?

You would need to check your deeds to see whether there is reference to an easement (legal right) in favour of the builder to construct services under your land. If there is then there may be nothing you can do. Depending on the wording of the easement it may well be that you cannot build over or within 3 metres either side of the pipe. But do check your deeds and if you think you have a case against the builder, contact a solicitor. It's usually a mistake to attempt to represent yourself
