• Land Registry Document Still Has Ex Husband's Name On

    Bought a house in 1994 with my husband. We later divorced and I bought him out and took on the motgage in my sole name which has now finished. Lender has now sent me charge certificate which still has my ex husbands name on. Do I need to do anything?

    I'd have to see the document to check it but I assume you are referring to an old land charges search or historic deeds which lenders often return when the mortgage is paid off. Check the date of the document to see if it is historic or something recent.

    I'd advise you check the title deeds (and HM Land Registry in case it has been registered, which could have happened since 1994) to make sure the property is in your sole name. Ask a professional conveyancer if you want them to check to make sure.

    You could order a copy of the up to date property register via http://land-registry-documents.co.uk/order-documents which will show who the current registered owners are. Charge certificates are no longer evidence of ownership and haven't been for a number of years
