• Land Covenant

All local residents in a former Council estate in West Ewell, Surrey were told by estate agents and the Council that the homes they were now buying from the Council were a really good deal. That partly to do with the cost of purchase offset by how many years you had rented, but also due to the fact that many properties adjoined the local school playing fields. The home buyers were told that they would never loose the view of the field as there was a land covenant meaning no building is allowed. Now a property developer has bought the land and is looking to build 161 properties on it. Should this have been disclosed at the time of purchase..

No but if they have breached the restriction or intend to breach it you may wish to take legal advice on enforcing the restriction to try and prevent the development.
