• Form K Restriction

    I have an interim charging order (form k) registered to me at my co owned property. It has no equity and we’re selling it for the value of the mortgage. My solicitor says that the restriction has to be settled as does the buyers solicitor, despite the Land Registry saying they would be removed on application with a certificate saying the beneficiary of the charge has been informed. What can I do?

    Take independent legal advice.

    From a practical perspective Form RX3 removes a restriction but of course make sure your interest is protected first.
