• Fence Ownership?

    We have a picket fence at the front of our property, the posts are on our side of the boundary and the front face of the picket fence is the boundary line (as agreed with a land surveyor). The plans have no T or H marks on any of the boundary fences so I assume the old law of who’s side the posts are takes ownership of that fence?

    If the fence is on your land and the deeds are silent, it will be yours in terms of ownership and yours to maintain.

    The deeds make written remarks to party walls and fences but none are marked as such, so I assume that if the posts are on our side of the boundary we are responsible for their maintenance and ownership?
    There are T marks on other fences that border our property onto a public footpath so it makes sense that any shared ownership or likewise would have also been marked on the plan as such?
