    A legal easement has been created over unregistered servient land which is unregistered. Land registration protection, seems to suggest that legal easements are overriding and therefore do not need to be registered at the Land Charges Department however it also refers to making a caution against first registration. Must a legal easement be protected by a caution against first registration application or will it be protected as an overriding interest?

    The servient land is now registered but the easement does not appear on the Title.

    I would always advise making an application for a Caution against First Registration to avoid any issues.
