• Do I Still Pay If A Charge Is Not Registered?

    divorced in 2017 home transferred solely into my name, court order (2017) gave a charge to my ex, I am now selling as he broke our maintenance agreement, only to find he never registered his charge, do I still have to pay him?

    Yes - you presumably have an obligation under the court order to do so and under any loan/charge agreement you signed with him, even if not registered.

    The lack of registration means that you can sell the property without having to get his consent and a signed discharge, so your buyer can take free of the charge regardless, but you would still have a binding legal agreement with your ex-partner to pay him the money owed.
