• Divorce Settlement Written In To Registry

By Guest on 15th Apr 2019

I am the executor of the will and selling a property from the deceased, there is a divorce settlement that states that the former spouse of the deceased shall get 7% from the sale of the property upon the sale. So the conveyancer has asked me for the contact details of the former spouse and with some difficulty I tracked him down to possibly living in a hostel to which I provided the address. As expected there has been no response from the letter sent out. The conveyancer has now said they are unable to proceed without a response. I find this hard to believe, what if the former spouse has passed away or is untraceable what happens then? Surely there is a course of action if there is no response, does anyone have any experience of this as it can't be a unique situation. Sounds to me that the conveyancer isn't very knowledgeable and is looking for the easiest option.
