    If a CH1 form dated 2004 was not sent to land registry can the charge still be acted on

    The lender likely has an equitable charge rather than a legal charge as the legal charge was not registered. It would mean there is still a charge but as it has not been registered over the property I suspect a court application will be required if retrospective registration is not available. I advise you consult a specialist conveyancing litigation solicitor.
