• Will Installing A Kitchen Extractor Vent Cause A Flying Freehold?

    I own a maisonette joining onto a side alley which I do not own. There is already a flying freehold created by having a flue outlet for my gas boiler on that wall.

    I am renovating my kitchen and there's limited options for external venting other than that wall. Will I create another flying freehold by installing a vent? Would it be resolvable by installing something that is flush, such as an air brick type vent (cannot post a link to an example) rather than something that protrudes (even if only a few mm).

    Any vent outlet is unlikely to extend past the guttering on that side of the building, so the building already extends into the alley. It is a rarely used alley for access only, so cooking smells are not likely to be an issue (and the freeholder is 2 doors down).

    This wouldn't be a flying freehold, and nor is the existing flue outlet. Ordinarily when you own land, you own everything from the centre of the Earth the the heavens. A flying freehold occurs where you also own part of the "airspace" of the adjoining land, and your property protrudes into that airspace. In your case, it's simply that the the flue outlet is projecting onto land you don't own. You may have rights of projection in your lease, and you should check that. Either way, if what you install doesn't prject beyond the walls you'll be fine
