• Transfer Ownership From Tenants In Common Follwing The Death Of My Father

    My father recently passed away and I am executor and trustee & have obtained a grant of probate. My Mother and Father were tenants in common in equal shares of the property with no mortgage. As per the will I now want to change the register/deeds to change his share of the propery into my name along with my Mother retaining her share. I have a an AP1, TR1 and ID1(for my Mother). If I complete these will this suffice to change the register as there is a standard restriction stating no disposition by a sole proprietor of the registered estate under which capital arises is to be registerd unless by an order of the court. I am aware that this is a standard restriction for tenants in common but will I need to remove this first or will it be ok as I have the grant of probate and there is no money changing hands.

    Your mother will be signing as Transferor as well as you so there will be two proprietors signing (your mother, and the estate of your father) so the Form A restriction will not prevent the transfer if the TR1 is properly completed.
