• Title Register In Maiden Name

    I am in the process of buying a house (freehold in England) from a married couple where the title register is still in the co-sellers maiden name. The seller property information and fixtures and fittings forms have been completed and signed in her married name. Their solicitor has drafted the contract of sale in her maiden name. I suspect from the charges that they have re-mortgaged recently (so possibly/probably in her married name - always assuming a joint mortgage). Need I concern myself, or should I have their solicitor address the issue? Thanks

    If the seller now goes by her married name then the contract and transfer should properly be drafted in that name and the solicitor should provide you with a certified copy of the sellers' marriage certificate to present to the Land Registry to deal with the discrepancy between the title and the transfer deed. Whether or not the property was mortgaged in maiden or married name is irrelevant. If she insists on selling in her maiden name then you should demand an explanation as to why and mere convenience is not a valid reason.
