• Second Charge

    My cousin who was registered proprietor of a Second Charge on a property has since died and his old address is still registered on the office copies. The property is now being sold. Do we have to send a copy of his Probate to the Land Registry in order that his beneficiaries can obtain the repayment of the charge when the property is sold

    I am not fully certain I understand what you are asking. During the sale process the seller's lawyer will supply the buyer's lawyer with a certified copy of the grant of probate to permit registration post-completion.

    Any chargees will need to be repaid to complete the sale and indeed registered charges will be dealt with in pre-completion replies to requisitions. We advise you consult your conveyancer.
