• Removing A Name From A Title

    There is a charge on marital home for a loan from my mother. The property and the loan are in my husband and my names (tenants in common).
    We are getting a consent order where I pay my husband a lump sum in return for the property being transferred into my sole name and I also take on sole responsibility for the loan charge. Can I, when the time comes, remove my husband's name from the title and from the loan charge, without using a solicitor?

    Hi, Although it is not necessarily wise, you can as long as you won't be taking out a mortgage to do it. You would need him to sign a transfer deed (form TR1) and unless he has a solicitor, a form ID1 (which he would need a solicitor to complete for him). You would also need an ID1. In terms of the charge, appropriate provisions would need to be included in the TR1, which your mother would need to sign along with you and your husband, to ensure that he is released from the debt. You would need t apply to HM Land Registry to register theTR1
