• LPE1 Form Requested But Lease Extension Is Required.

    I am a freeholder/landlord and my leaseholder is selling her flat. I have agreed to extend her lease for a fee plus increase in ground rent. Her solicitor has sent me the LPE1 form to complete but nothing with regards to extend the lease. I'm thinking the lease extension needs sorting out first, would that be correct?

    It could be done either way. The LPE1 should show the details of the lease at present (as the extension may never complete, for example if the tenant withdrew) and should be answered truthfully and carefully. The tenant's lawyer will no doubt have send details of the lease extension proposed to the buyer's lawyer. You can always add information to the LPE1, for example mentioning the lease extension is in progress and the proposed terms.
