• Family Law Or Conveyancing Issue Relating To Forced Transfer Of My Legal Share To My Property And Equity

    I'm being made by ( my estranged husband agreeing to a single remortgage with santander) forced to sign over my ENTITLMENT by a TR1 and RX 3 form and all rights and equity because the offer they made to him is running out and he feels hell not get another one,..... Is there any other way if I have to do this that I can legally protect myself and my interest in the property under the same right as a tenant in common which I still currently am?, as it seems rather unfair to be made to give this up because he said he's not making do it, the bank is, but he effectively is benefitting from it.

    I would advise you take professional legal advice from a family law solicitor on your rights and obligations under family law.

    From a conveyancing perspective, if permitted by the lender and other parties involved, you may wish to consider agreeing a private second charge or deed of trust over the property, or similar to help protect your interest in it.
