• Conduct Of Sale

    Hello,

    Joint owned property occupied by myself and four children has been ordered to sale in divorce proceedings. My ex husband has conduct of sale. The estate agent refusing to give to me copies of documents, purchaser details, their solicitors, memorandum of sale, information's. I believe that as legal co-owner and occupier have right to have all documents and information available and be able to participate on sale including signing of documents and decision making. What shall I do to gain such access, please?

    Check what the divorce proceedings order writes and see what rights do you have with regard to the conduct of the sale.
    Obviously, you have no rights over how the sale is conducted but it does not mean that you have no right of knowing about it or its details to ensure fairness to both the parties and fairness with regard to the transaction itself.
    If necessary go back to court to seek that right. What the court is unlikely to give you s joint conduct of sale because of the potential disputes and arguments in situations like this.
