• Can I Remove A Clause On The Draft Contract ...etc

    Can I write to the Vendor’s Solicitor to remove an item on the Fixtures & fittings under Comments, whereby the Vendor’s selling agent Bridgfords confirmed that all the deceased belongings will be removed before completion, yet the Contract says “No guarantee is given in respect to the Contents and the Buyer takes them as seen”! However, the Vendor’s Solicitor attached comments says “may be removed prior to completion”! Again, can I quote to their Solicitor that the above item needs to be corrected as per agreement with selling agent Bridgfords - all the deceased items/belongings in house, garage & shed to be removed before completion?
    Secondly, they sent me 2 draft Transfer Forms TR1 for approval & execution together with a copy for my use. Please correct me if am wrong: I sign both of them and return one on or before completion?! Item number 11 on contract states: The transfer to the Buyer will be in the form annexed herto and the Buyer shall execute the Transfer and deliver the said executed Transfer to the Seller’s Solicitor on or before completion.
    Thirdly, on the agreed date of exchanging Contracts, I can CHAPS the funds in the morning and go the Seller’s Solicitor office in the afternoon to exchange Contracts - the Contract they sent is “Completion information and Undertakings (3rd edition), is it this Contract that we exchange?!
    Fourth, on completion after transferring the 90% funds, can I advise the Seller’s Solicitor that either options available: going to their office to complete or by post; they indicated in contract by post.
    And last, is it the Seller’s Solicitor who contacts Land Registry to deposit the signed & dated copy of TR1? I don’t have to i.e. it’s Not the buyer’s responsibility!!
