• Vacating A Property Late...

    If the seller is told by his solicitor that it is ok to release keys to estate agent but receives no further call from his solicitor to confirm that funds have been received and he consequently moves the last of his possessions out of the property several hours after the buyer says completion took place, who is responsible when the buyer then claims damages against the seller for their costs and inconvenience of not being able to move in at the time that the contract said completion should have taken place?

    The contract is between you and your buyer therefore you are liable initially. If however you only committed the breach of contract because you were not properly advised by your solicitor then you may be entitled to be compensated for your loss. You should start by following the firm's internal complaints procedure and if you are not satisfied, you can approach the Legal Ombudsman.
