• Seller Signed TA6 Form And TR1 Transfer With, No Rights Of Way

    Really worried, advise would be very welcome, I purchased a property and there was no disposition registered on it regarding right of way for next door. My seller signed no to any rights of way on the property TA 6 form. I have the TA1 transfer form, no amendments or rights of way for next door were mention in the transfer. My situation is next door are now claiming a right of way across my garden. The seller has now made a statement saying next door has used this as a right of way. (In contradiction)
    Just before the sale next door requested for myself to agree for her to have a said right of way, on an uncorrerated self declaration unsigned in accordance with the declarations act. My purchasing solicitor said I did not have to agree, I did not sign or agree. The seller did not make this requested agreement apart of the purchase or a condition of the sale of the property.
    Can I fight this claim? I took title of the property title without any confirmed rights.
