• Remortgage On A Shared Ownership Property With The Leaseholder A Housing Association

    We are almost at completion on a mortgage with Leeds building society , we went with them as we wanted to take our equity for home improvement extension . We own 50% of a house worth 360k, we are remortgaging to 160k to redeem an old mortgage at 89k to leave us with 70k to do our build. We have got the formal mortgage offer and about to complete when our solicitor has said there are variations between the cml requirement and the lease clauses, who's responsibility is it to take a view of weather the lender is protected, the solicitor or the lender as right now they are batting it back and fourth ?
