• Can I Sue The Buyer If He Enters The Property Before Completion And Starts Works?

    My late fathers property is being given sold for probate. We have exchanged and am due to complete tomorrow. However I have found that the buyer has obtained the keys illegally and copied them and has had builders tearing the property apart for the past 3 weeks. My belongings are still in the property and they are now ruined. Help and advice appreciatedo.

    Your buyer had no right to enter the property prior to completion unless the executor of your late father's estate granted him access. If the executor didn't grant access then he has committed a trespass and can face both criminal charges and a civil action by you. How did he get the keys? If it was from the selling agent then you might have an action against the agent for ?breach of contract? ?breach of trust? - I'm not a litigator but suffice it to say, if the keys have been entrusted to the agent and he has handed them over to a third party without authority he may be liable for any resulting loss.
