• Buying From Bankrupt Sellers

    Good morning

    I am attempting to purchase a property whereby the joint proprietors have both been petitioned into bankruptcy in 2010.

    A trustee has been appointed for both parties and my offer for the property has been duly accepted by him. Due to the laws in place and the circumstances it is required that the joint proprietors sign the legal transfer of title. However, neither of the bankrupts are contactable.

    Is there any other way around this issue that will satisfy the Land Registry?

    The trustee in bankruptcy or another creditor can force the sale by obtaining a court order but otherwise there is nothing you can do. Where there are joint proprietors the legal ownership doesn't pass to the trustee in the same way as for sole proprietors
